Assignments and Name and Address Changes of international patent applications (PCT applications)

Costs

• Usually we charge on a per-file basis.
  • Usually we do not charge for name and / or address changes in a file, if we can charge for an assignment in the file at the same time.
  • Usually we do not charge for address changes in a file, if we can charge for a name change in the file at the same time.
• Usually we do not charge an additional fee for taking over representation of a file, if we can charge for an assignment, or a name or address change at the same time.

No documents required

For registering a transfer, a name and / or address change, it is not necessary for the WIPO to produce any assignment or other document by means of which the change in the person of the applicant was effected. Assignments and other documents relating to the right to file the international patent application (PCT application) may, however, be required by the designated Offices during the national phases. For instance the European Patent Office (EPO) and the German Patent and Trademark Office (GPTO) do not require any documents during the national phase in case the assignment, name and / or address change has been filed before the WIPO during the international phase.

We recommend that you send us a commercial register print out or an assignment proving the change in the English language, if at hand. Alternatively, kindly just advise of the new name and / or new address.

If you have / your client has already executed an assignment contract and the contract is not in English, German or French language, please send us an English or German language Google translation and a copy of the original assignment.

Representation

In case we do not yet represent the international patent application we need to take over representation when requesting the transfer or name and / or address change by presenting a Power of Attorney. Therefore, kindly fill in and execute / have execute our Power of Attorney form.

(No) Requirement to Update the Register

In general we recommend to file requests for registering assignments and changes of names and addresses during the international phase before the World Intellectual Property Organization (WIPO) in order to save on fees for requesting it with the national and regional offices.
