Documents and Information

We require the following documents and information for filing:

  1. name and address of applicant
  2. description, claims, drawings and abstract of the disclosure
  3. declaration of priority including date, country and application number, if any
  4. non-certified copy of the priority application, preferably electronic PDF-copy, if any
  5. name and address of each inventor and declaration as to how the applicant has acquired the rights to the invention (by an (oral) agreement or assignment including the date thereof or as employer(s))
  6. instruction as to whether request for

Examination request

Examination has to be requested within 7 years of the filing date.

Duration

The German Patent and Trademark Office (GPTO) distinguishes between three cases for the time up until the first / next office action:

  1. patent applications where examination has been requested within 4 months of the filing date or of the earliest priority in case a priority has been claimed:
    first office action will be drawn up within 8 to 9 months from the application date of the first priority (cf. note of the president no. 18/92)
  2. in case of other patent applications:
    first office action will be drawn up within 15 months from the request for examination
  3. second and each further office action:
    24 months from the preceding office action

In case you want / your client wants to receive an opinion on the patentability of the German patent application, we recommend to request search or examination when filing the application. In case we do not claim any priority for the patent application the GPTO will try to draw up a search report or a first office action within 8 to 9 months from the filing date.

A separate regulation on accelerated search does not exist.

Accelerated examination

The examination can be accelerated by a reasoned requested. No office fees are payable for accelerated examination.
