No search fee is payable if the European Patent Office has drawn up the ISR. In this case the examination fee amounts to 1730 €.
For claim fees the European Patent Office has established a two-tier system:
The examination fee is reduced by 50 % if the European Patent Office has drawn up the International Preliminary Examination Report (IPER).
The third renewal fee may be payable on or before the expiration of the 31-months time limit, if the PCT application has been filed within 8 or 9 months after the earliest priority. We do not charge attorney's fees for the payment of the third renewal fee, if it may be paid together with the other office fees for entering into the EP phase.
When entering into the European phase the application documents on which the examination is to be carried out must be specified. When doing this description can be reformatted and the number of claims of the PCT application can be reduced in order to save on page and claim fees, respectively.
In standard cases neither professional work nor translation costs are involved provided that the PCT application is in English or German language or we receive an English or German literal translation of the PCT application.
Later on we can file revised documents, e.g. an amended claim set comprising multiple dependencies and reference numbers. If we file only revised documents when entering into the European Phase, the European patent office (EPO) will probably issue a communication inviting us to file a nearly literal English language translation.
